Terms & Conditions of Sale

These Terms & Conditions (“Terms”) govern the purchase of goods from Botellas OÜ (“Seller”, “we”, “us”) via the online store at https://botellas.eu (“Shop”).
By placing an order, the customer (“Buyer”, “you”) confirms having read and accepted these Terms.
1. Definitions
- Seller – Botellas OÜ (registry code 16290046), legal alcohol distributor and importer.
- Buyer – a natural person at least 18 years old, or a legal entity; minors are not permitted to purchase alcohol.
- Shop – the website https://botellas.eu used to place orders.
- Order – the list of products selected by the Buyer.
- Agreement – a sales contract formed when the Buyer submits an order and the Seller confirms it.
2. General Provisions
2.1. These Terms are legally binding for all purchases made via the Shop.
2.2. The Seller reserves the right to update these Terms at any time. Updates appear on the Shop and take effect upon publication.
2.3. By placing an Order, the Buyer confirms that:
- they are at least 18 years old;
- they have provided accurate information;
- they agree to these Terms.
3. Conclusion of Agreement
The sales Agreement is considered concluded when:
- The Buyer selects products and submits an Order;
- The Buyer provides necessary contact and delivery details;
- The Seller confirms the Order by email and issues an invoice.
The Agreement becomes valid once payment is received.
The Seller may cancel an Order if:
- payment is not received within the stated deadline;
- the Buyer cannot be contacted;
- stock errors or pricing errors occur.
4. Buyer’s Rights
The Buyer has the right to:
- purchase goods according to these Terms;
- withdraw from the Agreement within 14 days as permitted by EU consumer law;
- receive goods that correspond to the description and quality stated;
- receive refunds for defective or incorrect goods.
5. Buyer’s Obligations
The Buyer must:
- provide true and complete information;
- pay for the Order in full according to the invoice;
- accept delivery at the agreed time;
- not purchase alcohol if under 18.
6. Seller’s Rights
The Seller has the right to:
- decline or cancel orders in case of misuse or fraud;
- correct pricing or stock errors;
- refuse the sale of alcohol to individuals who appear underage or intoxicated;
- temporarily suspend the Shop for maintenance.
7. Seller’s Obligations
The Seller must:
- deliver products as described on the Shop;
- ensure compliance with Estonian and EU alcohol regulations;
- provide accurate product information, including alcohol volume and origin;
- respond to Buyer inquiries within a reasonable timeframe;
- process returns and refunds according to law.
8. Payment
8.1. Payments are currently accepted only via bank transfer based on an invoice.
8.2. All prices are in euros (€) and include VAT where applicable.
8.3. The Order is processed only after the full amount of the invoice is received.

9. Delivery
Delivery options:
- Courier (Omniva/DPD/Itella) – Estonia-wide
- Pickup by prior arrangement at:

Delivery terms:
- Standard delivery time: 1–5 working days after payment receipt.
- Delivery fee is shown during checkout or on the invoice.
- In case of courier damage, the Buyer must report it immediately and take photos.
The Seller is not responsible for delays caused by the courier or force majeure.
10. Product Information & Shelf Life
- Product descriptions, alcohol volume, origin, allergens, and packaging information are displayed in the Shop.
- Colour or appearance differences may occur due to screen settings.
- Food items must be stored as instructed on the packaging.
- The Seller is not responsible for items that expire after delivery due to Buyer negligence.
11. Right of Withdrawal and Returns
11.1. Buyers have the right to withdraw from the Agreement within 14 days without giving a reason, in accordance with EU consumer protection rules, unless an exception applies.
11.2. The right of withdrawal does not apply to:
- opened alcoholic beverages;
- opened food products (due to health and safety regulations);
- perishable food products that are liable to deteriorate or expire rapidly;
- custom or special-order products;
- gift cards.
11.3. Food and beverage products that have a naturally short remaining shelf life or are otherwise perishable are considered “rapidly expiring goods”. For such products, the 14-day right of withdrawal does not apply. If a product has a short remaining shelf life, this will be indicated on the product page or product description. If such information is provided, the product is not considered defective solely due to having a shorter shelf life.
11.4. For non-perishable and long-shelf-life goods (including unopened alcoholic beverages and unopened packaged foods), the item must be unopened, unused, and in its original packaging to be eligible for return under the 14-day withdrawal right.
11.5. The 14-day withdrawal period remains valid even if the product’s expiry date occurs within that period, provided the product is not classified as perishable and the remaining shelf life was disclosed or is typical for the product category.
11.6. Return shipping is paid by the Buyer unless:
- the Seller delivered the wrong item;
- the item was damaged upon arrival;
- the item was expired at the moment of delivery;
- the item was significantly closer to expiry than reasonably expected and this was not disclosed on the product page.
11.7. Refunds are issued within 14 days after the returned items are received and inspected.
12. Data Protection
12.1. Personal data is processed according to the Privacy Policy available on the Shop.
12.2. Data is used only for:
- processing orders,
- invoicing,
- delivery,
- customer communication.
12.3. Data may be shared with:
- courier services,
- accounting providers,
- payment processors (if applicable in future).
12.4. The Seller complies with GDPR and Estonian data protection regulations.
13. Liability
13.1. The Buyer is responsible for providing accurate information.
13.2. The Seller is not liable for:
- delivery delays beyond the Seller’s control,
- Buyer’s misuse of the products,
- third-party website content linked in the Shop.
13.3. The party who causes direct damage must compensate it according to Estonian law.
14. Governing Law & Dispute Resolution
14.1. These Terms are governed by Estonian law.
14.2. Disputes will be resolved through negotiation.
14.3. If no agreement is reached, the Buyer may contact:
- Consumer Disputes Committee (TTJA)
- European ODR platform: https://ec.europa.eu/odr
- Or file a claim in an Estonian court.
